My Vrod Accident!!!

Shitty just doesn't explain it. Anyone that ran across the thread "Dealer doesn't have the right tool??????" Already knows the frustration that I was experiencing.

7 weeks ago I brought my bike in for CHROME lower legs, tripple tree, wheel spacers, clamshell, headlight bucket, brake calipers, drag bars, kuryaken turn signal mirrors, 28t pulley kit, hand levers, master and clutch resevoir, stainless steel idle and throttle cables, v omd exhaust, skullman shocks, rizoma belt guard and a 200 metz. I think that is about everything.

Through the seven weeks i was given one line of shit after another about when it would be done. I'd ask when and they had no idea. I'd ask how much for this or that and instead of being cordial and working with me there famous response is "you got the money we got the time"

Then they don't have the proper tools. After they get the tools they tell me they lost the 2 8mm bolts that are used to attach the upper and lower stock exhaust. One thing after another.

Fianlly last thursday i get the call that the bike is off the lift and ready to roll. PUMPED DOESN'T EXPLAIN HOW I FEEL. I have one of my co-workers give me a ride to the dealer. I put the $3432.57 on my visa grab my keys and i'm feelin like it's the first time all-over again.

Inspecting the bike i am just so estatic, i made quite a few changes and im thinking this bike looks Fu$%en great! I fire her up and she sounded even better. I Make the right turn out of the dealer, keep in mind i just got the 28t pulley so im geared up to see how that feels. I shift into second at about 5 Grand and BAM I don't know what happened but im now flying over the bars superman style. I take a hard dive bounce off the road and follow up with a nice slide into home. I thought the friggen tire came off, i had no clue what had happened.

All the smoke clears the cops and ambulance arrive, the techs form the dealer arrive (remember im only 200 yards from the dealer) The tech then says in front of everyone right to my face "we forgot to test drive your Bike, your front brakes are completely locked up"

Bottom line i got a good case of road rash, and a fractured shoulder. the bike has a split lower frame rail and minor shit like mirrors, shocks, windshield, clutch lever, handle bars, and so on.

Im just blowin off some steam and don't want to bring anybody down im just friggen enraged. I've decided not to have the bike fixed at that dealer. I'll be taking it elsewhere. For the $3,400.00 they reversed my credit card yesterday when i came to see the owner. (he called and wanted to see me) classy move.

Any clues on what could cause the brakes to lock up? They aren't tellin me much at this point. Just for my own head im tryin to figure out what could've gone wrong.

At least you are ok. :ithappen: But I would still be pissed. The owner was prob just trying to avoid a court case if everything is exactly how you described it looks like they are gonna be paying up.
That's a tough break. You should get an independent assessor to give you a report, then sue their f***in'ass. There is more to this than meets the eye, I can't imagine a situation that would cause the brake to lock, unless they didn't replace a pin in the pads & they got loose & jammed up somehow.
Anyways don't believe a word they tell you.
Sue there a$$. $3400 is an insult and pennies compared to what you deserve. Keep the hospital bills and get a lawyer. This is pure and absolute B.S. I'm getting pi$$ed just thinking about it. You could have been killed.
For the front brakes to lock up that fast it would not be an air and heat issue, it would had to have been something most likely installed incorrectly. I still can't figure how they did that much work and no one rode it before they put you on the bike.

Thank goodness you survived there work, at least this time.

If it was me they would be eating all that 3400 plus fixing the bike maybe even a new SE Duece that is some BS they really screwed up. The owner is scared you are going to own his dealership lol :stupid: :stupid: :stupid:
Sorry to hear that man. You MUST get an assessment of what caused the brakes to lock up first. But I think you know that. It will take time but I know that I would start a lawsuit if they are found responsible. You are truly a victim of circumstance beyond your control. There are too many dealers out there that just don't give it crap about quality and just want to get the bikes in and pump em out.
That fractured shoulder has a good chance of bothering you for a lifetime. Arthritis buildup in the joint could seriously bother you for a real long time. I would definitely pursue legal action and a new bike. Sometimes a wrecked bike will never be the same after an incident. Good luck and keep us posted. Hope you heal quickly.

Dan and I know ALL THE MONEY IN THE WORLD CANNOT REPLACE YOUR HEALTH!They are Liable and You should seek Legal Counsel immediately!Y a have no idea the Long term repercussions of your injuries in the years to come!That why they pay their insurance premiums !Sorry about what Happened but Be Smart about it also.Go see a Few specialist and have a Cat Scan and a MRI done to check extent of you're Soft Tissue Injuries!They are the ones that take so Long to Heal! :kaz:
Kaz is right about the long term effects, I got one of those long term bum shoulders. Glad to hear your intact, hope your recovery is speedy.
Jerry, first off, thank god you are in "healable" shape. To just reverse your costs they charged is not good enough and I would NOT settle for just that! The owner is just trying to save his hide. Call a lawyer that specializes in biker suits.

Glad your not too badly hurt, that could have been so much worse. You need medical reports coming out of your ears, and don't be in hurry, you got to heal first. Then hit them with your lawyers.

Thanks for the support and the suggestions. I have an MRI scheduled for three weeks from now. The ortho seems to think that i have soft tissue damage but wants to wait for the swelling to subside.

When i went back to the dealer they have already taken off the locked up calipers. They told me that the bike wouldn't roll (no shit) so they took them off and them put them back on. They have obviously tampered with the bike, which i believe is evidence. They said they can't look at anything until the insurance adjuster comes by. Is the insurance adjuster the person to give me an assessment on the brake failure? or is a specialist required? Any help would be greatly appreciated.
Take some Photos ASAP .....They will try to cover there Ass after you leave the bike alone with them.....

Was a police reprt filed for the accident? If not, than I "assume" it would be hard to prove anything was tampered with, especially if you allowed them to mess with the bike after the fact. I'd retain a lawyer ASAP before ANYMORE corresondance with the dealer. Certain things said and done may possibly reduce or even exempt them from liability and I am sure that the owner has already consulted his legal counsel...even if he is acting like a concerned party. There is a chance he could have some integrity, but guys with a lot of dough usually have all the tee's crossed and eyes dotted in sutuations like this.

Wife took photoss hours after the accident. We then took photos the day after which showed that the bike was tampered with. The police report states that the accident was caused by front brake lock up moments after driver (me) just payed for fron brake service. The owner admitted to my wife and i that he has no idea how the bike left the shop without being test driven. I've retained an attorney and have started the claims with my insurance company. Both medical and motorcycle. I just hope im covering all my bases, I haven't really been thinking so clearly. Just pissed off about the whole thing.
Before you call a lawyer ask for a new bike and what ever amount of money you think your doctor and you fell is right to cover any plain and repair that may be down the road. Plus how much you think you should get for the trouble they caused you. Then if they say no get a lawyer and make them sorry they did say no. You took the high road and a better man because of it.
