I'll bet the cop goes to prison. That higher standard stuff is crap. Who decides & how much higher is it supposed to be. The law is supposed to be the same for all. Anyone remember separate but equal.....

What would happen to the average guy in that part of the country. The real shame is the biker that was killed. Anything further on him.

Nothing new that I've heard - I'll look and see if there is a memorial fund or something. All I know is tha guy was 27 and on his way to work the late shift and that he is survived by a wife and a 4-year-old.

The county sheriff is a pretty straight shooter, as is the DA. I'm sure they'll bring charges, and pretty sure they won't swing a deal. The community is pretty outraged, especially given the high BAC - .24 is not just tipsy, it's stone drunk.

I'll keep posting as the case plays out.
 
I retired as a Police Leiutenant in 2000 after 26 years. It's true that LEO are held to a higher standard than the normal citizen. In order to be respected, you must first respect. LEO must pratice what they preach. If you F--- up you must pay the price as Joe citizen. Now, again there are certain situations that need to be investigated fully just like with any crime, in order to seek Justice. There are times when even the richest of the rich and the poorest of the poor mess up. No doubt about it. If you choose to have that drink, then you choose the consequences that may follow. For every choice in life there are consequences. Be responsible, don't think sh-t happens to everybody else. It happens right here at home. I respect all LEO that respect themselves, those that don't, need not wear the badge!
 
As a cop I hate hearing non police talk about the blue wall of silence or the like. That shit may have existed in the past but not anymore. I will not put my career and reputation on the line for anybody. If you are a cop and screw up like this idiot did then you will be charged and will go to jail.

They are taking their time with this case because a complete investigation has to be completed and sent to the ASA or DA. If the cops were to charge him at the scene knowing at that time that it was a Fatal they could run into a double jeopardy situation. This is standard operating procedure for any serious or fatal crash.

Suspension without pay more often than not means termination. You do not get paid while being on suspension and you cannot get another job while on suspension. Plus he will lose his pension . No way in hell will they ever offer this guy early retirement.

In memory of victim

I searched the local news sources last night to find out if there was any memorial fund for the victim's wife and four-year-old son. There is not, but the family has asked that anyone interested in paying respects to the deceased be encouraged to make a contibution to M.A.D.D. in memory of Peter Volkmuth.

Now I'm not advocating drunk driving, but I was arrested for a DWI back in 1999 and I blew a .27
This was after a full day of drinking at the beach for about 12 hours with no food at all. I had no business behind the wheel and couldn't even stand up when they pulled me out of the car.
I know quite a few troopers and police officers that party. But I have never seen one of them that drunk getting behind the wheel like this guy did. Its one thing to accidentally pull out in front of a motorcycle at night(hell it hapens all the damn time), but its another when someone is a policeman and drunk off his ass.
I think they should release him from his job first and then let the courts try him as a civilian. That way he is no longer a cop and he will face the law like a regular man that has commited involuntary manslaugter.

Deputy accused in fatal DWI still has his license to drive

(September 27, 2006) — PARMA — A Monroe County sheriff's deputy who was charged with drunken driving in Parma after allegedly hitting and killing a motorcyclist earlier this month still has a license to drive.

James R. Telban Jr., 44, of Greece pleaded not guilty to two misdemeanor charges of driving while intoxicated Tuesday in Parma Town Court.

The District Attorney's Office on Monday confirmed that Telban's blood-alcohol content was three times the legal limit the night of Sept. 6, when Peter Volkmuth, 27, of Greece collided with his pickup truck on West Ridge Road and died. Telban was pulling out of a country club about 10:15 p.m. when the crash occurred. Telban's blood-alcohol was 0.24 percent.

Parma Judge James Maley Jr. said he had not received evidence of Telban's level of intoxication and without it did not have the authority to revoke his license, which Assistant District Attorney Kristin Splain had asked for. The case has been waived to a Monroe County grand jury.

Outside the courthouse, more than a dozen motorcyclists who gathered along with friends of Volkmuth's family were disappointed at the outcome.

"If it would have happened to anybody else the guy would have been waiting for his trial in jail," said Michael Cavuto, president of the Monroe County chapter of ABATE, a motorcycle advocacy organization.

Telban, who refused a breath test the night of the accident, had his blood drawn almost three hours later, Splain said.

Telban left the courthouse in a vehicle driven by his parents, said attorney Joseph Damelio.
 
You know come to think of it the blue wall of silence when my Dad was a copy was a very long time ago, and it was not in the US, it was in the Canal Zone. They even had little tags on their car bumpers so as to identify each other that the public was not supposed to notice. I would imagine there are bad apples in every barrel no matter what group you're talking about.

As I said earlier in this thread - I'm following this case closely. What's really annoying at this point is that all he's been charged with three weeks after the incident is two misdemeanors.

I really hope to see the grand jury indict him for DUI manslaughter.
 
When I lived in upstate NY a friend of mine was in tight with the cops and occationally I'd go over to his house when cops were there.

The alcohol & weed flowed like a river thru that place and without exception the cops were blotto and would get in their personal cars and drive away.

Mostly I tried to stay away from that guy's house mostly because of the abuse I witnessed the police committing.

I find it very difficult to have respect for them when they violate the law at night that they enforce during the day. Now, I'm not saying ALL cops are like that, but from what I've seen with my own eyes there are way too many rotten apples in the barrel for me to trust and respect the police just because they wear a badge. I've known a few who have earned my respect and trust, but it's by no means global. If anything the opposite.

I'm sorry if some of you cops who are worthy are offended by this, but I'm not the only one with this impression of police. IMHO there's too much abuse of power.


I'll be very interested to see if this drunken killer cop gets the same treatment as the drunken killer celebrty biker.

Grand Jury to Hear Deputy DWI Case

A Monroe County Sheriff's deputy charged with DWI in connection with a crash that killed a Greece man made his first court appearance Tuesday night.

James Telban Jr. pleaded not guilty to DWI charges. Blood tests show his blood alcohol content was three times the legal limit the night he was involved in a crash that killed Peter Volkmuth of Greece.

Telban was visibly shaken at his arraignment. He quickly left Parma town court after pleading not guilty to two misdemeanor DWI charges. More serious charges are pending.

"At this time, once the investigation is completed we will be presenting the case to a grand jury to determine what the final charges will be," Kristin Splain explained. Splain is the director of the DWI bureau of the Monroe County district attorney’s office.

Telban’s attorney, Joe Damelio said his client is shaken up. "This is truly a tragedy. A good person and a father and a husband lost his life and a good person and a father and a husband and a dedicated public servant is charged with the crime."

Telban is accused of driving drunk the night of September 6. Police say the 44-year-old was leaving the Braemar country club around 10 o'clock when he pulled his pickup truck into the path of an oncoming motorcycle driven by Peter Volkmuth, 27 of Greece.

Volkmuth crashed into the side of the truck and died at the scene. A blood test taken the night of the crash revealed Telban's blood alcohol content was .24, three times the legal limit.

Volkmuth's wife and family were at the arraignment, but did not want to speak publicly. Members of local motorcycle groups turned out to support them.

Tiffany VanWyngaarden spoke on behalf of the Volkmuth family. "They don't have very much to say. They've said their piece. They want it taken care of. They want him to receive the full charges that anyone else who is charged with something like this would have gotten and And that's something they're going to push for," she said.

Michael Cavuoto of the group ABATE said, “we don't have a problem because he's an officer, we have a problem that a drunk driver killed a motorcyclist. That's why we're here."

Many of those who attended the arraignment were angry because the judge did not suspend Telban's license. Attorneys on both sides explained it was because the proper paperwork needed to do that was not in place in time for the court date. Telban's license could still be suspended as this case moves forward.

The district attorney’s office hopes to present it to the grand jury within a month.

thats a pretty irresponsible statement and as a fla state trooper i take offense by it. tell me what you do so i can have equal time! there are quite a few leos on this forum, where do you get off insulting them!

just for the record, if a cops an asshole, the other cops think he is too!
 
i own a bail bond co. so yes i have seen for years that cops do not pay the same as everyone else!! sorry but it is true, i know some great guy's who are cops but you know that a lot of times you do take care of your own! and to add to this , like i have said on here before, i was hit head on about a year and a half ago by a off duty police officer who was on the wrong side of the road passing cars just like billy lane was, lucky for me and my wife and two kids , we were in a big SUV and he was in a small car , well to make a long story short NOTHING EVER happend to him! total cover up even after witnesses came forth, so yes stuff like this pi$$es me off, police dep. need to be fare, and people like me would not feel this way!!! sorry if i offended you
 
you are a real self proclaimed expert! what ever you want to think about cops, i dont really care. there are a lot of inmates in prison that share your opinion. i just dont see why you want to insult fellow forum members. surely you dont think your comments are objective,
in case you arent aware, there are a lot of citizens who hate motorcycles. if it wasnt for those cops you despise, you wouldnt be able to ride on the street.

as a matter of fact, i was rear ended by a female running about 100 in the rain in atlanta 3 years ago on I-85. she was a dumbass and i dont care what she did for a living as she almost killed me.
